After this guy gets let go he deletes bunch of stuff from his work computer. Later, after he gets threatened with legal action, he gets rid of his phone and wipes his computer. The court found that the work computer was not subject to ediscovery sanctions because he did not anticipate litigation. The phone and the laptop were after he should have known about the litigation therefore he had a duty to preserve. The court did not grant default judgment because there was plenty of evidence available from other sources and the court was not convinced that the destroyed evidence was necessarily a rich source of evidence.
